How to apply for a US family visa?

The goal of the American family migration program is to reunite eligible family members with their American relatives. It is possible for family members of LPRs or US citizens to migrate to the United States and join them there permanently.

To apply for family immigration, you must meet the following requirements:

  • The sponsor must be a legal US citizen or permanent resident.
  • To file a petition for a sibling or parent, the sponsor must be at least 21 years old.
  • To sign an Affidavit of Support, Form I-864 or I-864-EZ, a U.S. citizen or lawful permanent resident (LPR) must be at least 18 years old and have a home (domicile) in the U.S.
  • Sponsor must have enough money and assets to support the family moving to the U.S. and must have their main home, or domicile, in the U.S.
  • The person who wants to help the family move must be ready to sign an affidavit of support.
  • The petition for an immigrant visa, I-130 (Petition for Alien Relative), should be approved by USCIS. This is the job of the sponsor.

Process
Step 1 – Application Process
For details on how to apply for a visa based on a preference for a close family member or other relatives, see the Immigrant Visa Process on usvisas.state.gov. Please refer to the National Visa Center’s (NVC) guidelines and the material on this website for additional instructions and guidance after completing these steps.

Step 2 – The Interview

The National Visa Center (NVC) will examine your file for completeness after you have finished the steps on the Immigrant Visa Process on usvisas.state.gov, including paying the necessary fees and submitting the required immigrant visa application form (DS-260), Affidavit of Support, and supporting documents. NVC will work with us to arrange an interview appointment for you once your case is eligible for one. On usvisas.state.gov, you can find more information about the interview procedure.

Step 3 –  Case Status
At the conclusion of your interview for an immigrant visa, the consular officer will either approve or deny your visa application. After the visa applicant’s interview with the consular officer, some visa applications require additional administrative processing, which takes additional time. Applicants are informed of this requirement at the time of application. The majority of administrative procedures are completed within sixty days of the visa interview. When administrative processing is necessary, the timing will vary depending on the specifics of each case.
On ceac.state.gov, you can check the status of your visa application. If your visa was denied, you may find helpful information on usvisas.state.gov regarding Ineligibilities and Waivers.
Step 4 – Following The Interview
You will be informed how and when your passport and visa will be returned if your visa is approved. Review After the Interview on usvisas.state.gov to learn what to do after receiving your visa, how to enter the United States, how to pay the USCIS Immigrant Fee, and other important information.
